General Terms and Conditions

for purchases from www.artaqua.co 

1. area of application

For all deliveries of Art Aqua to consumers (§ 13 German Civil Code) these general terms and conditions (GTC) are valid.

2. contracting party

3. offer and conclusion of contract

The presentation of the products on our homepage does not constitute a legally binding offer, but a non-binding presentation. After you have provided us with your personal data, we will submit an offer to you. With the acceptance of the offer it comes to the conclusion of the contract and binding sales contract.

4. Delivery

Unless otherwise stated by us in the product, the standard delivery time for our articles is approx. 14 working days (Europe-wide). You will be informed immediately of any delays in delivery. If necessary, we are entitled to make partial deliveries. Additional shipping costs for partial deliveries will only be charged by agreement. In the event of non-availability of the ordered goods, we reserve the right not to deliver. In this case we will inform you immediately.

5. right of revocation

Consumers (§ 13 German Civil Code) have a statutory right of revocation.

Cancellation policy:

You can cancel your contractual declaration within 14 days without giving reasons in writing (e.g. letter, fax, e-mail) or – if the goods are delivered to you before the deadline – by returning the goods. The period begins after receipt of these instructions in text form, but not before receipt of the goods by the recipient (in the case of recurring deliveries of similar goods, not before receipt of the first partial delivery) and also not before fulfilment of our duties to provide information pursuant to Article 246 § 2 in conjunction with § 1 para. 1 and 2 EGBGB (Introductory Act to the German Civil Code) and our duties pursuant to § 312e para. 1 sentence 1 BGB (German Civil Code) in conjunction with Article 246 § 3 EGBGB. The timely dispatch of the revocation or the item shall be sufficient to comply with the revocation period. Consequences of revocation in the event of an effective revocation, the services received by both parties must be returned and any benefits derived (e.g. interest) must be surrendered. If you are unable to return or surrender the performance received and benefits (e.g. advantages of use), or are only able to do so in part or in a deteriorated condition, you must compensate us for the loss of value. You only have to pay compensation for the deterioration of the goods and for the use made of them if the use or the deterioration is due to the handling of the goods which goes beyond the examination of the characteristics and the mode of operation. By “testing the properties and functionality” we mean testing and trying out the respective goods, as is possible and customary in a shop, for example. The goods will be collected by us. The obligation to refund payments will be fulfilled within 30 days. The period begins for you with the dispatch of your revocation or the goods, for us with their receipt.

6. prices and shipping costs

6.1 The gross prices of our goods include the statutory value added tax and other price components.

6.2 Shipping costs are generally included in the price within Germany, Austria and Switzerland or upon collection. If necessary, additional shipping costs will be communicated separately before the conclusion of the purchase contract.

6.3 For deliveries to non-EU countries, additional customs duties, taxes and fees will be charged.

7. Payment

7.1 Payment shall be made on the following corporate bank account:

7.2 You shall only have a right of set-off if your counterclaims have been legally established by a court of law or are undisputed or have been recognised by us in writing.

7.3 You may only exercise a right of retention if the claims result from the same contractual relationship.

8. retention of title

Until the complete payment, the goods remain property of Art Aqua.

9. contract text storage

We store the contract text and send you the order data and our AGB by e-mail. You can see and download the AGB at any time also here on this side.

10. Warranty

The statutory warranty provisions apply.

11. service

The seller offers the buyer a service to maintain the functionality of the goods during the period of use. This service is liable to pay costs after expiration of the warranty and requires an order outside of the contract. The service of Art Aqua can be reached under +49 1523 7800892

12. taking back the goods

The seller takes back the goods for disposal after the expiry of the period of use. The buyer undertakes to return the goods to the seller after use and not to put them into the public disposal cycle. Please contact our service hotline. (see 11.)

13. contract language

The language available for the conclusion of the contract is German.

14. place of jurisdiction

In the event of any disputes arising from the contractual relationship, legal action shall be brought before the court having jurisdiction over the head office of the seller.

15. Final clause

15.1 Should any provision of these General Terms and Conditions be invalid, the remainder of the contract shall remain valid. The relevant statutory provisions shall apply in place of the invalid provision.

15.2 German law shall apply.

15.3 All communication shall be conducted in German or English.

15.4 All brand names mentioned are registered trademarks of their owners and serve only to indicate the compatibility of the products mentioned.

15.5 The product images shown are for illustrative purposes only and may vary in appearance. We reserve the right to make technical changes in the interests of progress.
